We are Big Sound Limited, 19 Rutland Square, Edinburgh EH1 2BB. All purchases from our website are subject to the following terms and conditions.

 1 General

1.1 We reserve the right to amend these terms and conditions from time to time. Changes will be effective upon posting on our website. Each time you place an order you will be asked to read and accept our terms and conditions so you should always be familiar with the most up to date version.

1.2 We only supply to businesses and organisations and do not supply to consumers. You confirm that you have the necessary authority to enter into this contract on behalf of such a business or organisation, and that you will indemnify us against all losses and expense which we incur if this is not the case.

2 Contract

2.1 You will be given an opportunity of checking and if necessary correcting your order before it is submitted to us. Once submitted, we will send you an email acknowledging receipt of your order. This is not an acceptance of your order.

2.2 The contract between us will be formed once we accept you order. We will send a further email to you to confirm that you order has been accepted. This email will also contain information about delivery of the products ordered.

2.3 We reserve the right to decline some or all of your order for any reason. We will advise you of this by email.

3 Prices and payment

3.1 All prices shown on our website are in UK pounds sterling exclusive of VAT and delivery charges.

3.2 Delivery charges and any other applicable charges will be clearly stated before you are asked to submit your order.

3.3 We can take payment by credit card when we process your order, or we will accept payment by cheque or BACS transfer. Payment must be made in full before delivery.

3.4 All our products are subject to availability and if we are unable to supply the goods you have ordered we will advise you as soon as possible. Where you have already paid for these you will be given a full refund.

3.5 Occasionally, the manufacturer will change the product specifications. If you have ordered such a product we will give the option of continuing with the product or taking a substitute product of equal or better value, at the same price. 

3.6 We take great care to ensure that the prices shown on our website are correct. However in the unlikely event that a mistake is discovered we will contact you immediately. You will be given the opportunity of cancelling or continuing with the order at the correct price. If you cancel and have already paid for the goods you will be given a full refund.

4 Delivery

4.1 We only deliver to customers in the United Kingdom, and all goods must be signed for by a representative of the business or organisation making the purchase.

4.2 Our estimated time for delivery will be stated in the email we send you confirming acceptance of your order. We hope to deliver these estimates but occasionally delays will occur, despite our best efforts. We will not be liable for any delay or failure to deliver within such estimated timescales.

5 Cancellations and returns

5.1 If you wish to cancel the contract before delivery then we will refund monies paid less any delivery, restocking fee or similar charge which we incur. We cannot accept cancellation after delivery unless in terms of clause 6.

6 Warranty

6.1 We undertake that we will, at our option, either repair or replace the goods where defects are found, despite proper use of the goods, within 12 months from the date of delivery or uplift of the goods, provided that:

a) you give us notice in writing immediately the defect is noticed;

b) we are satisfied that the defect is solely due to faulty design, workmanship or materials; and

c) the goods claimed to be defective are returned to us at your expense

6.2 Where we are unable to repair or replace a defective good we will offer a refund or exchange.

6.3 Our obligation under this clause does not cover faults caused by misuse, wear and tear, accident or neglect.

6.4 We are not liable to compensate you for any losses incurred as a result of the return of a defective good.

7 Liability

7.1 We will not be liable for any losses you incur arising out of or in connection with online purchasing from our website.

7.2 Notwithstanding the terms of clause 7.1 in the event that we are held liable for losses which you have incurred arising out of or in connection with online purchasing from  our website, our liability to you shall be limited to a sum equal to the amount paid by you for the products purchased.

8 Governing law

8.1 These terms and conditions and all transactions relating to this website are governed by Scots law and are subject to the exclusive jurisdiction of the Scottish Courts.
